Is there a statute of limitations on dog bite claims?

admin » 31 August 2011 » In Dog Bite Accidents, Uncategorized » No Comments

The statute of limitations on dog bite claims is three years from the date that the dog bites you.  Like any other negligence statute in Massachusetts you have three years from the date that dog bites you or causes you injury to make a claim.  As a child, however, you  have three years from the date you turn 18 to make that claim.

Using Visuals to Help a Jury Understand Your Claim

admin » 31 August 2011 » In General Law » No Comments

Often times when a Personal Injury case goes to trial, it can be many years after the incident which caused the injury.  With this time hopefully comes health and healing for the injured.  It also means that a jury or an insurance company will often wonder what is actually wrong with the person in front of them.  It can be tough for a plaintiff to explain through words and medical records alone the extent of their traumatic injury, just how much the pain took from them, and the toll on their life and those around them that brought the plaintiff and their loved ones to the courtroom.  Hip and Soft Tissue Injury

At Mazow|McCullough, we strive to bridge this gap of understanding through the innovative use of visuals and technology in the courtroom and mediation.  Wherever possible, we use carefully selected and tailored visual graphics to present a true idea of the damage caused to the plaintiff.  We strive to present complicated ideas and issues in a clear and concise way to help the plaintiff tell their story.  We find that through the correct use of these visuals, we are able to better represent our clients and assist them in seeing a just end to their claim.  CT Scan

If you or someone you love has been injured recently, please call Mazow | McCullough to set up an appointment.  There is a never a charge to a client for representation, and we are experienced and agile at finding the best way to tell the truth about your injury.  The right lawyer makes all the difference.

Why are insurance companies such a pain to deal with after an accident?

admin » 24 August 2011 » In Uncategorized » No Comments

Generally speaking, in Massachusetts, insurance companies are not bad.  Insurance companies are in a business to limit the amount of claims that they pay out on these types of accidents.  Insurance companies have a duty and responsibility to their boards of trustees and their stockholders.  It’s their job to keep profits high and keep pay-outs low.  It’s not that they’re bad, it’s just that they will do what they can do to keep pay-outs as low as possible.

Can children file a claim in a wrongful death case?

admin » 17 August 2011 » In Wrongful Death » No Comments

In the state of Massachusetts, the children of a person who has passed on or who has been killed do to the irresponsibility or negligence of another party, they have the ability to go forward with a claim.  The estate would name an administrator.  The children would not be the administrator of that estate, but the children would be beneficiaries of any moneys or a settlement that would be achieved as a result of that claim.

Do bus-pedestrian accident lawsuits differ from car accident lawsuits?

admin » 15 August 2011 » In Uncategorized » No Comments

In the state of Massachusetts, bus driving incidents involving pedestrians are very different than your typical car accident.  That is because of the commercial entity; who owns the bus?  The different rules and laws in presenting the injury claim on behalf of the injured party to the bus company vary.  You’re dealing with different parties, not your typical automobile insurance company, but in fact the bus may be state owned or state funded and those specific facts determine how the claim needs to be presented, and who it needs to be presented to.

Tour Bus Accident

admin » 09 August 2011 » In Auto Accidents, Bus Accidents » No Comments

With the summer comes an urge to travel.  Whether it is to share the wonderful weather with friends or family, go visit a beautiful area of our country or to simply enjoy exploring new places; hitting the road is a time honored American tradition.  Many of us take the bus to get from here to there, letting someone else deal with the driving, stress and traffic that can come with a summer road trip.

Most of the time, these trips are uneventful periods between home and your destination, where you may enjoy the scenery and also meet interesting people.  Unfortunately this is not always the case.  Bus companies often force their drivers into extended working hours to cut costs, ignore reports of unsafe driving, fail to investigate the background of those they employ, or simply neglect to maintain their vehicles.  The passengers’ safety may be an after-thought for the big companies.

If you or someone you love has recently been involved in a bus accident, contact the law office of Mazow|McCullough, P.C. today.  We have experience dealing with the complicated cases that can arise out of the negligence of both a company and an employee.  We can help you to feel empowered again, as you are compensated for you or your loved one’s injuries.  The right lawyer makes all the difference.
